Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Who this notice applies to

This notice describes the privacy practices of Haven Therapy + Wellness and of every clinician who provides care through our practice. We are required by law to protect the privacy of your health information, to give you this notice explaining our legal duties and privacy practices, and to follow the terms of the notice currently in effect.

How we may use and disclose your health information

For treatment. We use your health information to provide and coordinate your care. For example, your therapist records notes about your sessions in order to plan and deliver treatment, and, with your written authorization, may consult with your physician about how your care fits together.

For payment. We may use your information to bill you and to document the services you received. Haven is a private-pay practice and does not bill insurance. If you ask us for a superbill so you can seek out-of-network reimbursement yourself, that document will contain a diagnosis and service codes, and submitting it to your insurer is your decision.

For health care operations. We may use your information to review and improve the quality of our care, to train and supervise clinicians, and to run the practice. When we use your information for supervision or consultation, we limit what we share to what is necessary.

Uses and disclosures that require your written authorization

Some uses always require your signed authorization, and you may revoke that authorization in writing at any time, except to the extent we have already acted on it. Psychotherapy notes: most uses and disclosures of psychotherapy notes require your written authorization. Psychotherapy notes are the notes your therapist keeps separately from the rest of your record documenting the contents of a counseling session. Marketing: any use or disclosure of your information for marketing purposes requires your authorization. Sale of information: we do not sell your health information, and any disclosure that would constitute a sale requires your authorization.

Uses and disclosures we may make without your authorization

The law permits or requires us to share information in limited circumstances: when required by law, including reporting suspected abuse or neglect of a child, an older adult, or a vulnerable adult; to prevent serious harm, where if you communicate a serious threat of harm to yourself or an identifiable person we may disclose the minimum information necessary to prevent that harm; for health oversight activities such as licensing board investigations; in judicial and administrative proceedings when we receive a court order, though we will not release records in response to a subpoena alone without your authorization or a court order; for public health activities required by law; to law enforcement in the narrow circumstances the law permits; to coroners, medical examiners, and funeral directors as permitted by law; and for workers’ compensation as required by law.

Substance use disorder records

If we receive records about you from a federally assisted substance use disorder treatment program, those records are also protected by federal law at 42 CFR Part 2, which is more restrictive than HIPAA in several respects. Part 2 records generally may not be redisclosed without your consent, and they may not be used or disclosed in any civil, criminal, administrative, or legislative proceeding against you without your written consent or a court order issued after notice and an opportunity to be heard. We do not use substance use disorder records for fundraising.

Telehealth and electronic communication

Haven provides care entirely by video. We use platforms and vendors that have agreed in writing to protect your health information. No electronic system is perfectly secure. Email and web forms are not secure channels, and we ask that you not send clinical or health details through them. If you contact us electronically, we will respond in a way that protects your privacy.

Your rights

Access your record. You may inspect and get a copy of your health information, including an electronic copy, and you may ask us to send a copy to someone you designate. We may charge a reasonable, cost-based fee.

Restrict disclosure to a health plan. If you pay for a service in full out of pocket, you have the right to ask us not to disclose information about that service to a health plan, and we must agree. Because Haven is private-pay, this is our normal practice.

Request other restrictions. You may ask us to limit how we use or share your information. We are not required to agree to every request, but we will tell you if we cannot.

Request confidential communications. You may ask us to contact you a particular way or at a particular address. We will accommodate reasonable requests.

Amend your record. You may ask us to correct information you believe is inaccurate or incomplete. If we deny the request, we will explain why in writing and you may submit a statement of disagreement.

An accounting of disclosures. You may request a list of certain disclosures we have made of your information.

Breach notification. We will notify you if a breach compromises the privacy or security of your information.

A paper copy. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.

Our responsibilities

We are required by law to maintain the privacy of your health information, to give you this notice, to notify you following a breach, and to abide by the terms of the notice currently in effect. We may change this notice, and any change will apply to information we already hold as well as information we receive in the future. The current version will always be posted on our website with its effective date.
